Open Access titles are titles that have permissive access rights but varying right of use. In general they are distributed under Creative Commons licenses which does not govern access but end use. However, in the spec it is unclear if using open access acquisition link is actually required . The regular acquisition link would suffice.

Our "open-access" rel value might be misleading:

Indicates that the complete representation of the Resource can be retrieved without any requirement, which includes payment and registration.

This is quite different from OA as a business/license model.

An OA title could be acquired through any of our existing rel value IMO.

I think since 2010 the meaning of the phrase "open access" has sort of spread out to cover a wide variety of related concepts. We can't change "open-access" in the spec, but we can add a clarifying comment.

If it's really confusing we could define in OPDS 2.0 a relation called something else, like "anonymous-access" or "immediate-access", with "open-access" a deprecated synonym.
