<p>憲法訴訟法今年上路了,許多案件風風火火地開了言詞辯論,司改會也在這半年間送出4份法庭之友意見書、提供書狀範例協助將近600位當事人提出聲請。憲法訴訟法上路後,舊法時代下的案件必須在施行後半年內提出法規範審查,許多在舊制下「被剩下來」的案件,在聲請的大門關上前,奮力丟出最後一份聲請,至今還留存著一絲被受理的希望。也有些當事人,在大門關上前,早已收到了不受理的決議,在新制下,不再有機會再聲請。</p>
<p>方少威,今年73歲,我們都稱呼他為方伯伯,在台獨自照顧112歲母親,因為《臺灣地區與大陸地區人民關係條例》及相關許可辦法中不合理的規定,至今無法申請定居,他因此展開多方陳情與法律上救濟。他的案子,即是舊法下被大法官不受理的案件之一。</p>
<p>從2018年,司改會與台權會陪著方伯伯一路走到今天。當司法與人權交會,我們與時間賽跑,卻仍只能看見無根的未來,但方伯伯不曾放棄。</p>
<p>這期我們訪問到方伯伯本人,讓他好好說出他的故事。同時,我們訪談到司改會憲法訴訟法專組的召集人,同時也是台權會的會長周宇修律師,記錄這一路在救濟上的努力。</p>

<p>方少威最主要遇到的問題在於最初設計條文時,設計者只預設了大陸地區人民來台居留的狀況是父母親跟隨小孩來台,可是方少威的情形正好相反,造成同樣都是跟隨親人的腳步來台、同樣都是一個家庭,卻只因為照顧者與被照顧者的身分不同,在法律上像方伯伯一樣的照顧者反而無法留在台灣照顧長輩。⋯⋯</p>

<p>來過司改會辦公室,大概對於整牆的司改雜誌並不陌生。時光推進,走過司改雜誌中那些過去改革的歲月,我們未曾止步。</p>
<p>隨著司改會投入的工作項目日益增多,攤開現在內部工作會議的議程,光北部辦公室包含法案政策跟個案就共有20個組別,除了司改會這麼多的法律議題、政策、個案之外,我們還希望讓大家看到背後這群相信改革、努力實踐的人們,他們的身影與故事。</p>
<p>適逢疫情期間無法辦實體活動,電子媒介對於訊息的傳播更加重要。於是決定重啟電子報。沒有主編也沒有責編,靠著各個部門在份內事務以外時間抽空帶著志工完成,希望帶給大家軟性的司改之思,給大家更多不同的故事。</p>
